These terms govern your use of Nibble. By using our service, you agree to these terms. Please read them carefully.

1. What Nibble Does

Nibble is a trading name of Clerky Limited, a company registered in Ireland with company registration number 557553. Our registered office is Newtown, Rathcoole, Co. Dublin. VAT number: IE3372058PH. When we say "Nibble", "we", or "us" in these terms, we mean Clerky Limited trading as Nibble.

Nibble provides online ordering software for independent food businesses ("Merchants"). We help Merchants accept orders from their customers ("Customers") through web-based ordering pages. We also process payments on behalf of Merchants through third-party payment providers.

2. Who These Terms Apply To

These terms apply to:

  • Merchants - Food businesses using Nibble to accept orders
  • Customers - People placing orders through Nibble-powered ordering pages

3. Merchant Accounts

Creating an Account

To use Nibble as a Merchant, you must create an account with accurate information. You're responsible for keeping your login credentials secure. You must be at least 18 years old and legally able to enter into contracts.

Your Responsibilities

As a Merchant, you agree to:

  • Provide accurate menu information and pricing
  • Fulfil orders you accept in a timely manner
  • Comply with all food safety and hygiene regulations
  • Handle customer complaints and refund requests fairly
  • Keep your business information up to date
  • Not use Nibble for any illegal purpose

Our Commission

Nibble charges a commission of 2% on the total value of orders placed through your ordering page. This commission is deducted automatically from payments before they reach your account. Payment processing fees from Stripe or SumUp are separate and charged by those providers directly.

4. Customer Orders

Placing Orders

When you place an order through a Nibble-powered ordering page, you're entering into a contract directly with the Merchant, not with Nibble. Nibble facilitates the transaction but is not a party to the sale.

Payments

Payments are processed by third-party providers (Stripe or SumUp). By making a payment, you agree to their terms of service. Nibble does not store your full card details.

Refunds and Complaints

Refund requests and complaints about orders should be directed to the Merchant. Merchants are responsible for their own refund policies. If you believe a Merchant is acting fraudulently, please contact us.

5. Acceptable Use

You must not:

  • Use Nibble for any unlawful purpose
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt our services
  • Upload malicious code or content
  • Impersonate others or provide false information
  • Use automated systems to access our service without permission
  • Resell or redistribute our service without authorisation

6. Intellectual Property

Nibble and its original content, features, and functionality are owned by Nibble and are protected by copyright, trademark, and other intellectual property laws.

Merchants retain ownership of their content (menus, images, branding) but grant Nibble a licence to display this content as part of the service.

7. Data and Privacy

Our Privacy Policy explains how we collect, use, and protect your data. By using Nibble, you agree to our Privacy Policy.

8. Service Availability

We aim to keep Nibble available at all times, but we don't guarantee uninterrupted service. We may need to suspend the service for maintenance, updates, or unforeseen circumstances. We'll try to give notice when possible.

9. Termination

By You

You can close your account at any time. There are no lock-in contracts or cancellation fees. Outstanding commissions on completed orders will still be due.

By Us

We may suspend or terminate your account if you breach these terms, engage in fraudulent activity, or for any other reason with reasonable notice. We'll try to warn you first unless the breach is serious.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Nibble is provided "as is" without warranties of any kind, express or implied.
  • We're not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability is limited to the amount you've paid us in the past 12 months.
  • We're not responsible for the actions of Merchants or the quality of their food.

Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Disputes

If you have a dispute with us, please contact us first at hello@nibble.ie. We'll try to resolve it informally.

These terms are governed by the laws of Ireland. Any legal proceedings must be brought in the courts of Ireland.

12. Changes to These Terms

We may update these terms from time to time. We'll notify you of significant changes by email or through the service. Continued use after changes means you accept the new terms.
